The first thing you need to know is that to get a divorce in Florida you will need to be a resident of the state of Florida for at least 6 months prior to the filing. The second is that Florida is a “No-Fault” State meaning that lawyers cannot write the fault of a particular party in the petition for divorce in order to get the divorce granted. There are only 2 reasons for divorce. The first is that it is “Irretrievably broken”, which means you can no longer live together. The second reason is due to “Mental incapacity”, which requires that the spouse be adjudged incapacitated for at least 3 years before submitting the petition. Be advised that with a divorce counseling might be required.
Once the process to dissolve your marriage starts other areas of the law might come into consideration such as: alimony or custody. There are various reasons for alimony to be granted and it will depend on your personal case. Various situations are taken into consideration for alimony. For example: your needs, your ability to pay, if you are studying, how long you have been married, and others. The court will determine if alimony is required, but we will help you with a thorough evaluation of your situation to prove the need of alimony.
